Producer Sues 50 Cent, Lil Kim Sued Over "Magic Stick"

Rapper 50 Cent and Lil' Kim have been with a $2 million lawsuit by producer Carlos "Phantom of the Beats" Evans, who claims he was never paid royalties for producing the hit single "Magic Stick."

 

The lawsuit was filed yesterday (September 11) in Manhattan State Supreme Court by Carols Evans, who claims he signed an agreement to produce and mix "Magic Stick," featured on Lil Kim's 2003 album La Bella Mafia.

 

Evans claims he was paid $7,500 for his production work on the single, which hit #2 on the Billboard Hot 100 and sold over two million copies.

 

He hasn't seen any royalties since the album's release in 2003.

 

"It was one of the hottest tracks on that album, and I didn't collect my royalties," Evans told the Associated Press.

 

According to 50 Cent's lawyer Theodore Sedlmayr, the issue is an accounting issue, because Evans used a sample in "Magic Stick."

 

"Atlantic is trying to get it straightened out," Sedlmayr said. "If after the accounting Mr. Evans is entitled to anything, he'll get it then."

That would be like the producer of Irreplaceable suing Ne-Yo for not getting paid by Columbia- wouldn't make no damned sense, would it? Same situation here. 50 was just the writer of the song. He don't have no control over who the hell Atlantic pays, unless he (50) didn't give the guy producer's credit on the song. Once his name is in the credits as the producer, it is out of 50's hands and it is all on Atlantic's accounting department when/if everyone gets paid.

The $7500 was a producer advancement fee...Since he's the producer he should have gotten his royalties (less the $7500 for the advancement) ......I cant speak how samples work I dont sample. He shouldve gotten his first check after 8-9months after the accounting.

the artist doesn't pay the royalties out, the publishing entity does, be it BMI or ASCAP, perhaps it was filed incorrectly because even with the sample, a percentage would still go to 50, Kim, the producer, and whoever performed the song that was sampled....sounds like dude opted for a quick buck and neva had his B.I. str8 and someone put a bug in his ear about how he could've got more $$$$ and jumped at it...

For an unproven producer selling a sample-based beat, $7500 is a little above the going rate, and when they cleared the sample they probably had to give up most of if not all the publishing to the artist whose work was sampled.  This Phantom dude is shooting himself in both feet by doing the lawsuit because no one will want to deal with him now.  He should have chalked it up as dues being paid and overcharge niggas later for what they did to the Cold Crush.

well the song was originally 50s' he couldnt find a female to spit on it and when he got kim to do it they couldnt get it cleared in time so it went on her album. thats what kicked off they lil beef with each other

Even though this track was on Lil' Kim's album,  50 Cent own the rights for the song. This song wasnt even slatted to be released on her album. The song just missed 50's album deadline and was put on kims album. Kim had to pay alot of royalties and publishing rights to have that song on her album. So this has alot to do with 50 cent.
